1. Welcome to our website. By continuing to browse and use www.mygift.org.uk ("our Website"), you are agreeing to comply with and be bound by the following terms and conditions of use (our "Terms and Conditions"), which, together with our Privacy Policy, govern our relationship with you and your use of our Website. 2.The terms ‘us’ or ‘we’ refer to ‘The Charity Service Limited’, a charitable company limited by guarantee, whose registered office and place of business is at 6 Great Jackson Street, Manchester M15 4AX. Our company registration number is 2538910 and our registered charity number is 1011293.

4.From time to time we may change our Terms and Conditions, or update them. It is your responsibility to access and check our Terms and Conditions whenever you access our Website. The latest version of our Terms and Conditions will govern any future use by you of our Website.

Changes to the Service

5.We will make every effort to ensure that our Website and other services are available for use continuously, but we reserve the right to modify, suspend or discontinue all or any part at any time, with or without notice. Unless specifically exempted, any new features, services or software applications we introduce will also be subject to our Terms and Conditions.

Gift Aid Information

6.When you make a donation via our Website and confirm that you are a UK taxpayer in accordance with the requirements of the UK government's Gift Aid scheme as they apply from time to time, we will reclaim Gift Aid on that donation.

7.We are not accounting, taxation or financial advisers, and you should not rely on any information given on our Website to determine the accounting, tax or financial consequences of making a donation to charity. We strongly recommend that you consult your own advisers about any accounting, taxation or financial consequences that may affect you.

Our fees

8.To cover the costs of running the website and the costs of our charity we retain a small proportion of your gross donation as well as recovering the costs levied on us by banks and credit card and card collection companies. The gross donation is the amount you send to us plus any Gift Aid and Transitional Tax relief claimed from Her Majesty's Revenue and Customs. The full table of how those deductions apply is shown on the website.

9.Our annual accounts showing how all our funds are applied are also on the website and we welcome all enquires about the working of The Charity Service.

Your Donation to MyGift

10.Some organisations which offer a similar service to MyGift collect funds (and reclaim Gift Aid) on behalf of specified charities. Any charity that wants to benefit from their services must enter into a contract with them and they usually charge a monthly subscription fee.

11.MyGift is different. We don't ask charities to sign contracts with us or pay fees to us, so you can donate to any charity you want, however small, and there is no need for the charity to contact us, take legal advice, or pay us a fee. Because we are a registered charity, all our profits are used to improve our services, or are donated to other charities.

12.Because we don't ask charities to sign a contract with us, we cannot act as their agent or direct conduit for any donation. This means that we cannot collect money for them or reclaim Gift Aid on their behalf. Instead, the donations are paid by us into a special charitable fund, and then are paid out again to charities.

13.When you make a donation, we will ask you to tell us how you would like us to spend it. You can nominate any registered charity in England and Wales as your preferred recipient. We keep separate management accounts in respect of donations, so that we can account to you for the donations you have made and reassure you that your money is being dealt with properly. In any charity, the trustees must have the power make the final decisions about how the funds are spent, so we cannot guarantee that your donation will be sent to the charity you have specified, but in nearly twenty years of trading, our trustees have never failed to honour a donor's wishes.

Online donations and unauthorised card use

14.For your protection, all online credit or debit card transactions are processed through a secure server site.

15.Please note that all donations made via our Website are irrevocable charitable gifts and are not contingent on, for example, the successful completion by the fundraiser of a sponsored event or activity. The only circumstances in which refunds will be made is where unauthorised use of your payment card is proved. If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider in accordance with its reporting rules.

Protecting your password

16.You are responsible for maintaining the confidentiality of any password you use for our Website. If you become aware of any unauthorised use of your password, we recommend that you change your password immediately or call our helpdesk on 0161 839 3291.

Privacy Policy

17.All personal data that you give us in the course of using our services will be dealt with in accordance with the Data Protection Act 1998 and our Privacy Policy.

18.Our Privacy Policy forms part of these Terms and Conditions. By agreeing to these Terms and Conditions you also give your consent to the way we may handle your personal information under our Privacy Policy.

Your use of our Website

19.You must use our Website and our other services in a responsible and legal manner at all times. In particular, but not exclusively:

(a)You agree not to upload offensive, obscene or racist content, including photographs, on to our Website. We do not actively moderate our Website content, but we reserve the right, at our sole discretion, to remove or edit any content posted on our Website without notice, regardless of whether in the opinion of any third party, it is offensive, obscene or racist. (b)If you build a personal fundraising page on our Website, you are responsible for the content of your page. Where the copyright status of any photograph, logo, picture or copy is in any doubt we reserve the right, at our sole discretion, to remove such content without notice. 20.The names MyGift, The Charity Service, TCS, the MyGift logo, The Charity Service logo and any other product or service names that we may present on our Website from time to time may not be used in connection with any product or service that is not ours, nor in any manner which is likely to mislead or confuse, or in any way which may damage, disparage or discredit us.

21.Other trademarks, logos or service marks which appear on our Website are the property of their respective owners. They are likely to be registered trademarks and be subject to restrictions on their use. You must not use them without our prior written consent, and that of the trade mark holder.

28.Hosting your personal fundraising page on our website does not in any way indicate that we, or any other charities, endorse any fundraising activity you undertake.

29.We are not responsible for any dissatisfaction you may have regarding a charity's use of any funds made available to it through us.

30.You agree that your use of our Website is on an "as is" and "as available" basis and that your use of our Website is at your sole risk. We do not guarantee continuous uninterrupted or secure access to our services and operation of our Website may be interfered with by numerous factors outside of our control. On that basis, except as expressly set out in these Terms and Conditions, we do not provide conditions, warranties or other terms in relation to our Website, to the extent permissible by law. We shall undertake general maintenance and upkeep of our Website from time to time, during which our Website shall not be available for use.
